The world of protection order hearings are unique in a number of ways. While the names of protection orders seem to have criminal undertones — Anti-Harassment, Anti-Stalking, Domestic Violence, Sexual Assault — they are nothing like criminal proceedings.
Civil protection orders are heard in front of a commissioner, rather than a judge, and the standard of evidence is only a preponderance — more likely than not — as opposed to the much higher standard of proof beyond a reasonable doubt in criminal cases. There are no juries in protection order hearings either, and testimony is rare. Rather, declarations are filed and arguments are then made at the hearing itself.
