The best outcome in a criminal case is the one where charges are never filed. Before the prosecutor makes that decision, there is a window to get ahead of it, and in each of these cases our own investigation and mitigation work was enough for the state to decline to file.

Rape 3 Accusation by an Ex-Girlfriend: No Charges Filed

Client accused of Rape in the Third Degree — an ex-girlfriend accused the client of rape many months after they broke up. An extensive defense investigation exposed ulterior motives and also produced witnesses who revealed that the accuser had made contradictory statements. We also put together a comprehensive mitigation package with additional witness and character statements, along with a polygraph. In the end, the state had enough information from both sides to make the right call — to decline to file any charges and close out the matter completely.

Workplace Sexual Assault Allegation: No Charges Filed

Client accused of sexual assault by a co-worker. It was someone who was a friend of his, and they had at one point kissed but never had sex. Nonetheless, a complaint was made to HR, which then turned into a police report. We launched our own investigation and provided the state with a trove of communications that served as strong evidence that everything that occurred between the two of them was completely consensual. That, combined with a comprehensive mitigation package, was enough for the prosecutor to decline to file charges.

Rape 2 Accusation After a Dating App Meetup: No Charges Filed

Client accused of Rape in the Second Degree. After meeting someone online, the client and accuser met up at an Airbnb and proceeded to have a great night out. They went back to the AirBnb and had sex. The client thought all was good the next morning, but she then accused him of rape. He retained our firm, and we got to work. We gathered all relevant messages and media exchanged, reviewed surveillance footage, put together a comprehensive mitigation package, and had our client take a private polygraph test that he passed with flying colors. After reviewing everything in detail, the prosecutor declined to file any charges.

Pre-Trial

Being charged is not the same as being convicted. Each of these cases was dismissed before a jury ever heard it, taken apart through discovery, defense investigation, and witness interviews until the state or the city had nothing left to take to trial.

Domestic Violence

Domestic Violence Assault 4

Assault in the Fourth Degree — Domestic Violence. Client accused by his girlfriend of hitting her multiple times. After a thorough review of all discovery, including extensive body-worn video, holes in the City’s case started to appear. That was followed up with defense investigation and witness interviews. Despite mounting very favorable evidence on behalf of our client, the city refused to dismiss the case. Undeterred, we confirmed the case for trial and pushed further. As the trial date drew near, things continued to look promising for us. Then, on the eve of trial, the City finally relented and dismissed the case completely.

Drug Crimes, Sex Crimes

Possession of Depictions of a Minor: Felony Sex Charges Dismissed

Possession/Dealing in depictions of a minor engaged in sexually explicit conduct. Client accused of possession & Dealing. Facing prison, felony sex crime convictions that could never be vacated, and 15 years as a registered sex offender. There was no question the client had illegal images on his devices. That said, through defense investigation and mitigation, we were able to establish that the illicit images and videos were sent to him unsolicited by someone he was communicating with online. He then sought to delete them all at once but ran into a network issue that prevented him from doing so immediately. Nonetheless, we were able to convince the prosecutor to dismiss entirely.

Two Counts of Rape 2, Two Accusers: Entire Case Dismissed

Client charged with two counts of Rape in the Second Degree, by two separate accusers. We took the case over from another law firm that had an offer on the case that would have sent the client to state prison. After working on the case with our defense investigator for two years and fully preparing for trial, including conducting comprehensive defense interviews with all witnesses and both accusers, the state’s case began to unravel. The first count was dropped, and then finally, after dogged persistence, the second count fell as well, and the entire case was dismissed.

Trial Cases

Some cases are only won in front of a jury. In each of these, the offer on the table was not good enough, so we rejected it, went to trial, and put the accuser’s account under cross-examination until the only verdict that made sense was not guilty.

Assault, Violent Crimes

Assault 1 with a Firearm Enhancement: Not Guilty on All Counts

Client charged with Assault in the First Degree — Firearm Enhancement and Unlawful Possession of a Firearm. Client’s ex-wife claims she saw client driving while she was in the car with another man and that our client started shooting at her. Client facing over 20 years in state prison. A pre-trial offer was made, drastically reducing the case to Assault in the Second Degree, but the offer was rejected, and we headed to trial. The other person in the car proved to be a poor eyewitness, and shoddy police work meant video evidence was inconclusive. The client also had an alibi and ended up testifying in his own defense. He also had a prior conviction the jury heard about. After a hard-fought battle and a long deliberation from the jury, they came back and fully acquitted him of all charges and lesser included offenses.

Domestic Violence

Domestic Violence Strangulation Charges: Not Guilty at Trial

Client charged with two counts of Assault in the Second Degree Domestic Violence and two counts of Attempted Assault in the Second Degree — Domestic Violence. Client was in a tumultuous dating relationship. He tried to break things off, and it did not go well. He gets accused of trying to strangle his girlfriend, hitting her in the face, and “fracturing” her wrist. The state made an offer for the client to plead to a misdemeanor Assault in the Fourth Degree. The offer was rejected, and we headed to trial/ The trial can best be described as a disaster — for the state, that is. The accuser’s version of events fell apart under cross-examination. With her credibility shot, there was only one verdict that made sense. Not guilty on all counts, and that’s exactly what the jury did.

Rape of a Child Charges: Acquitted After a Four-Week Trial

Client charged with multiple counts of Rape of a Child in the Second and Third Degree. He was facing an indeterminate sentence if convicted at trial, with a minimum range of 17-23 years in prison and the possibility of life in prison. After thoroughly preparing for trial for over two years, the trial itself was a four-week battle with relentless cross-examination of the accuser, exposing countless inconsistencies and severely damaging her credibility. In the end, the jury acquitted our client of all counts.
